Terms of Service

Last updated: October 2026

The service

MixerApp is an event matching service operated by Troven Inc. (49 Kearney Street, Guelph, Ontario, N1E 7B9, Canada). Organizers use it to register attendees, check them in, collect their choices at an event and tell them who they matched with. These terms are an agreement between Troven Inc. and the business or person who signs up as an organizer ("you"). The service is for adults; you must be at least the age of majority in your province or territory and have authority to bind your business.

Accepting these terms

You accept these terms when you confirm acceptance where we ask you to (in the organizer console or by email), or by continuing to use the service after we tell you they apply. We keep a record of which version you accepted and when, so we can show it later. If you do not accept, do not use the organizer console.

Your account

You are responsible for your account, for keeping your password secure, and for what your staff do with it. Give staff access to attendees' information and choices only if they need it to run your events. Tell us right away at hello@mixerapp.ca if you think someone else has access.

Price, billing and refunds

The price is $19.99 Canadian dollars (CAD) per event, for an unlimited number of participants, plus applicable taxes. Taxes are calculated by Stripe from the billing address on your account. You provide a card through Stripe. Your card is charged when you run matching for an event; there is no monthly fee and no per-participant fee. Charges are final once matching has run. We never see or store your card number; payment is collected by Stripe.

Your data, your responsibility for consent

Your roster belongs to you. You decide who attends and why their information is collected, and we handle it on your behalf to provide the service. On the participant profile page we also collect some information directly, as described in our Privacy Notice.

You promise that, for every person you add or import (by hand, by CSV file, or from a ticketing site such as Eventbrite): you are allowed to collect and use their information; you have their consent to contact them for the purposes you use us for, in line with Canada's anti-spam law (CASL) and privacy law; and for any past-customer list you upload, those people have an existing relationship with you, or have agreed to hear from you. You will not upload purchased, rented or scraped lists. Each marketing email you send must identify your business with your real mailing address and contact details, and you must complete the sender-identity confirmation in the app before any marketing email goes out.

You are responsible for the wording of the emails you send or approve through the service, including the results, introduction, invitation and no-show templates you edit. We do not review that wording. If you include promotional content, such as news of your other events, you are responsible for making sure it complies with CASL and that you have the consent it requires.

We honor unsubscribes automatically. You will not try to add back anyone who has unsubscribed or withdrawn consent, and importing a file will never override an unsubscribe.

We can pause or limit your sending, or suspend your account, if we have reason to believe these promises are not being kept, if emails draw complaints, or to protect other organizers' sending reputation.

What participants see

How participants' information is handled is set out in our Privacy Notice. In short, matched participants see each other's first name, last initial, photo, phone number and nametag number, and you can see the full roster. You will not use participants' information for anything beyond running your events and the marketing they agreed to, and you will not share it with anyone who does not need it.

Acceptable use

Use the service only for events for adults who have chosen to take part. Do not use it to harass or deceive anyone, to collect information you have no reason to collect, to send spam, or to test or probe the service's security without our written permission.

What we do

We use reasonable measures to protect your data: separation between organizers' data, encrypted connections, access controls, regular backups and monitoring. Backups are kept for up to 30 days, and weekly backups for up to 180 days. If we learn of a breach affecting your participants' information, we will tell you promptly so you can meet your own duties. When your account ends, you can ask us to export your roster, and we will delete or de-identify your participants' information on request, except what we must keep as proof of consent.

Availability

We aim to keep the service running but do not promise it will always be available or error-free. Run matching in good time, and keep a fallback (such as your paper list) for the event itself. We are not responsible for delays or failures caused by email providers, payment processors, internet connections or other services outside our control.

Liability

To the extent permitted by law, our total liability to you for any claim relating to an event is limited to the fees you paid us for that event (or, for a claim that covers several events, for those events). We are not liable for indirect, incidental or consequential damages, including lost ticket sales or lost profits. Nothing in this section limits any right or remedy you cannot lawfully give up.

Your responsibility for claims

You will defend and compensate us against claims by participants, regulators or others that arise from your events, your roster, the wording of your emails, or your failure to have the consents you promised above, except to the extent we caused the problem.

Ending the agreement

You can stop using the service at any time; there is nothing to cancel because there is no subscription. We can end or suspend your account for breaking these terms. Sections on your data and consents, liability, and governing law continue after the agreement ends.

Changes

We may update these terms. We will tell you by email before a material change takes effect, and you accept the new version when we ask you to or by continuing to use the service after the change takes effect.

Privacy

Personal information is handled as described in our Privacy Notice.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario.
